It is very unlikely that it would be a problem. To block that, they would have to update the actual hardware or some firmware in the CPU or elsewhere. I do not believe Kobo have done that, and if they did, it would cause problems with doing a factory reset to recover from problems. The factory reset is putting it back to an old firmware that is stored on the SD card and Kobo does not update that. And if the device didn't work after that, there would be a lot of complaints.
The only issue so far with this is that the older devices can no longer be updated via WiFi after a factory reset. Kobo had to remove older security protocols from their servers. The devices that use these will not update. But, they can be using the Kobo desktop application or by manually putting the update on the device. Once that is done, there are no issues.
