I told them to send me an epub/kepub file that they tested with then. They said they couldn't do that, but I could download a free ebook that is non-drm from the Kobo store.
I downloaded Pride and Prejudice, which is listed as DRM-FREE EPUB and the person I was working with agreed this should work. It didn't. As a comparison I sideloaded the epub and i downloaded a copy from the Kobo store via the cloud. Notetaking/markup worked great on the version downloaded via the cloud and it failed 100% on the version downloaded and side loaded.
On the side loaded version the pen would turn the page if i swiped it left/right, but no markup at all was able to be performed.
I have been told that my case has been transferred with an upper team so they can investigate more. Once they get an update, they will get back to me via e-mail.

Your first line contradicts the rest. The support person seems to think that sideloaded epubs are supported. And has in fact reported it as a bug. It might come back as "not supported", but at the moment it appears to be a bug.
