Yes it still happens. And it happens because that is what the book tells the device to do. For epubs, Kobo renders the start of the book and uses what should be the first page as the cover. If the first page is a small image stuck in one corner, than that is what will be used. As far as the device is concerned, this is how it is supposed to be. And I have a few books where the first page is an image with the title and author in text.

Just using the cover image in the epub is a problem for a couple of reasons. One is they aren't always marked correctly. The other is that if the epub has DRM, then the image is encrypted. I do not believe it is possible for them to get the unencrypted version.
