I think the most likely way to get an older firmware from amazon is to buy a kindle without ads - as they have a longer delivery time frame. I'm assuming this is because they need to be dug out from the back of a warehouse, so are less likely to be updated.

I would guess that no ads version would usually have older firmware because they sell slower. If they are in stock but take longer to deliver, I think that would be because they are in a warehouse farther away. If they are longer to deliver because out of stock, I think that increases the chance of getting newer firmware.

Updated to add: Or maybe certified refurbished kindles are less likely to have the most up-to-date software?

In my limited experience, refurbished kindles have older firmware.
