3rd party pens will always specify if they are EMR or will say what devices they support. If it says something like replacement pen for galaxy note then you know its EMR. If its not a 3rd party pen then you just look at what device the pen is for and see if its an EMR device.
if its not an emr pen it will say "active stylus". so yes, you can always tell what you are buying
