According to that license, yes. Remember, this is open source software and the license allows others to take it and make other versions or use the code in other ways. If anything, the problem is that they don't show the derivation of the software. This might be included when it is installed which would probably solve any issues.
Of course, I assume as you think it is a problem that you have reported this to MS using the link on the page. Maybe they will agree with you.
