Only the copyright holder can issue a take down notice. At best, if you notify Smashwords that you think one of the books isn't a legal version, they contact the publisher or copyright holder. Most of the time, they don't do anything since usually they don't have to resources to chase down the copyright holder and ask. If it bothers you that a book you think isn't legal is in a book store, then the best thing to do is contact the copyright holder or his or her agent and report it. I've done that before. If the author is dead, it can be a lot of work.
