One thing I would be worried about if I was a publisher — what happens if OpenLibrary starts using higher quality OCR so their eBooks are no longer such a big mess (as the lawsuit acknowledges is true now).

I think the plaintiffs might be wise to settle for OpenLibrary going back to one loan per copy and signing a pledge to never increase their scan quality.
