so out of interest, to answer the problem, for some reason in the epub3 format, indesign is creating two toc.xhtml files, one with capital letters TOC.xhtml, and one with small letters toc.xhtml, in sigil I deleted one of them and saved it and the book validates fine. I don't know what the cause was though.
