If you are using the browser to download books, then, as Kovid said, it is the firmware on the device deciding where the book is downloaded to. The download location defaults to the root directory of the main storage. I would have expected it to download to the SD card when the main storage is full, but, the definition of "full" could be the problem. Kobo tries to keep somewhere between 100 and 200MB free for firmware updates and start putting books downloaded from the store onto the card at about 100MB full. I don't know the exact numbers. These come from questions to Kobo and some experiments I did a few years ago. And they might have changed.
If this did happen with a previous firmware, it could be a deliberate change or a bug. As they haven't sold devices with external SD cards for a while, it wouldn't surprise me if this was something they dropped or missed in testing. I would suggest reporting the problem to Kobo. And, do you know what the last firmware version it was where it did work? That would help in the report, and knowing that, it might suggest whether it is deliberate or not. And I'd be curious to test it.
Another thing you can do is ask about a patch in the Kobo forum. There might already be one, or it could be easy to add.
