I can confirm this is happening to me as well.

I hadn't noticed it before because all the epub2s I've converted so far had .html files, and renaming them to .xhtml (after converting to epub3 but before getting around to running epubcheck) had the surprising side effect of adding <title></title> to the nav.xhtml. Running Mend will also add the <title></title>, not surprisingly.

But if the epub2 starts with .xhtml files and you don't run Mend to catch it, epubcheck will flag the missing <title>
