Ye gods, you need a MUCH more aggressive and assertive lawyer. I mean...I can't imagine a lawyer here just shrugging and putting up with that, putting the family through all this when the outcome is so patently assured, really. (assuming that selfsame judge hasn't been paid off, that is.) It's NUTS.
