If the device is legit (not a lost or stolen device) and the previous owner kindly provides you with her/his registered email account in Amazon, also her/his registered address in Amazon; then you can ask Amazon via chat or phone to deregister the previous owner and registered the device to your Amazon account. I did that for my Kindle DX last time. I hope it works for you. They will also ask the serial number and some other information about the device.
