At least some refurbished Kindles did not get firmware updated during refurbishing, but I don't think there is any way to know whether it will happen.

"factory firmware" and "consumer firmware" are shorthand for "factory use firmware" and "consumer use firmware". "factory use firmware" never leaves the factory except by accident.

The only way to know the firmware version is to open the box, turn on the Kindle and check ithe device info in settings. It all depends on luck. There is no guarantee on getting the version you want.
