Maybe the same artist did both?

Maybe the original artist never claimed copyright? (it's not automatic)

Maybe the second artist is a child, trying to make a name for themselves working under moms/dads (the original artists) guidance?

As the saying goes, "An assumption is the first step towards a screw-up". We can't assume the second derivative work is not sanctioned. It may well be.
