As a demonstration that MOBI formatting is better it fails. Part of the problem is that the two books are very different. Looking at it, the list in the MOBI is probably just paragraphs with a hardcoded number. The list in the EPUB might be done using OL and LI tags. Or it could be done with paragraphs inside a BLOCKQUOTE or a DIV or simply with different left margins to give the indent.

Whatever the reason for the difference, it would be easy to code the EPUB to give exactly the same layout as the MOBI. And odds are, if you use calibre to convert the MOBI to EPUB, you will get the same result. And my understanding is that the MOBI format is a lot more limited than EPUB.

Each format supported on the Kobo devices have support different features. Some are obvious (no dictionary support in CBR/CBZ), while some, like this are not so obvious. Kobo's support for MOBIs is really only there as a checkbox on marketing material. Hence, they haven't bothered to do all the support for the format that might be possible. Overall, you are better to use an EPUB version if you have it, or convert to EPUB or KEPUB.
