First point. We're not talking about the second issue here — we're talking about the one issue from the OP.

Now the facts.

Fact. Kindle locked up in the middle of an automatic update.
Fact. Kindle was not locked up BEFORE the update or it couldn't have attempted the update.

I think the evidence is strong enough here. Of course we could discuss what the definition of "is" is, I guess — if we were a couple of professional liars ... err .. lawyers.
