I have a Note. I haven't noticed the scratches, but I can tell you that both the Note and the Max 2 are designed to be flexible and not solid. Either one will have a slight "give" to it when you touch it or write on it. I don't know why Onyx deliberately chose a flexible design for these two. It doesn't bother me since I expected it.

As far as which one, that might depend on the size of the pdfs you read. If you are using A4, you might find the Max 2 a little better. Anything smaller than A4, and the Note should be fine. The Note works very well for me on the typical 8.5 x 11 inch pdfs one finds in the USA.
