I wasn't implying fault, merely that this was the easiest for Project Gutenberg to comply with a German court order (and basically German law). We shall have to see how appeal shakes out but this could be just another extension of how the law enforces geo-restrictions (in this case EU copyright law). Certainly makes a case for US to further synchronize with the EU on copyright (we are fully synchronized for post-1978 works.)
