No, they haven't yet made the source code available and one backer has publicly questioned their ability to do so. Unsurprisingly, they have not responded to the that post which was made more than three weeks ago..

They have. however, processed at least one refund from a very disgruntled backer. So they are perhaps not entirely without some scruples.
