At present there is no software solution to this problem. You can JB the device via the serial port with the proper hardware and procedure, but this of course requires opening the unit which would void the warranty of a new device. See the thread about serial JB if you wish to take this approach.
Assuming that you purchased this new from Amazon or a store you should be able to return it for a new unit, although they might ask a reason for the return. Once you have another new unit don't let it connect to the internet until you have taken appropriate measures.
