In my limited testing I was unable to get publisher panels in a sideloaded KFX file to display on my e-ink Kindle running 5.8.9 firmware. The same file when sideloaded to the Kindle for Android app did show the panels in Guided View mode, so I believe that the panels were formatted in the KFX file properly.

I took a look at a few comics that I have on my Amazon account and in all cases the ones that include publisher panels are delivered in KF8 format, not KFX. (The same comics are instead delivered in KFX on Kindle for Android.) Perhaps publisher panels isn't currently implemented in the KFX renderer in e-ink Kindles.

I am a novice when it comes to comics/manga so I may have missed something.

One more thing: Each KFX file contains a list of "content features" that it relies on, such as publisher-panels. Amazon's servers check the capabilities of the device/firmware requesting download of a book and only delivers KFX if that device/firmware supports all of the features used by the book. Otherwise it falls back to KF8 or MOBI format.

It is fairly easy to extract the list of features from a KFX file, but I do not know of any way to determine what features any particular KFX renderer implementation supports. Amazon must have a table in their servers, but doesn't expose that information.
