Where is the error?

You did not read the first sentence of the first post and your Kindle is not running a firmware version prior to 5.8.8

Version 5.8.8 is not prior to 5.8.8, it is the same as 5.8.8
Translation: JB does not work.

Version 5.8.9 is not prior to 5.8.8, it is more recent than 5.8.8
Translation: JB does not work.

Version 5.8.10 is not yet released, no assumptions about it can be made.
There is no way to tell if the first sentence's logic will hold for a firmware version that has not yet been released.
If the logic does not hold, then I will edit the sentence to include the exception.

It has happened before, where the protection against a certain jail break skips one or more firmware versions. That is just an artifact of Amazon/Lab126's build system and the way they maintain their changes.

One long standing example is firmware version 5.6.1.1 -
The build for PW-3 included downgrade protection.
The build for PW-1 did not (and does not) include downgrade protection.
(Different SoC device models and the DGA protection wasn't ported to the PW-1 build system. Mistakes happen. If Amazon was concerned they would release a 5.6.1.2 for the PW-1.)
