The result of tapping a link depends on what you actually tapped. Did you actually tap that tiny little number the book creator decided to use because that's how it's done in a paper book? Or did you tap somewhere off to the side? And when you missed the link, did you tape the area to turn the page, or the area to display the top and bottom bars?

This actually works well. The issue is that the tap zone for a superscript number referring to a footnote is small. It's the size of the number. And if it was bigger, you would be complaining that the device was inaccurate and triggered a link even though you hadn't actually tapped the link. What you need to do is convince the ebook creators to take advantage of the media and use decent links in their ebooks.

Would you please stop demonstrating how little you know about using your Kobo device under the guise of telling people about it's defects?
