For what it's worth I side-load a lot of books on my Kindle. I keep Wifi on and Whispersync on. I also make safe backups of the books I buy from Amazon and either side-load them or email them to my Kindle through Amazon so I don't have to worry about maximum copies. I have several Kindles.

I have no idea if Amazon knows what I'm doing. I do know they don't care. They may have a record of it all but I don't care.

At one point I was concerned that they might care about me emailing books to my Kindle that I'd bought from other stores and converted to mobi so Amazon can send them back to my Kindle. I live in a rural area without a car so I depend on Amazon and I don't want to hurt my relationship with them. I called and talked to a support guy about what I was doing, specifically in this case about sending books through their system for my Kindle when I'd bought them elsewhere. The guy asked around and called me back the next day and said no-one there saw any problem with it and a number of people at Amazon do that, as well.

A few months later something made me worry about it again, probably something I'd read, so I called them and got pretty similar information. So Amazon thinks this is okay. I think it's okay. I decided not to worry about it.
