It might be a legitimate concern. It's possible to install updates the wrong way.

No one bothered to reply. Hope that means everyone is doing it right.
You should also check the version number in the device information. I know I have so many files named KoboRoot.tgz that I sometimes get confused. Thus for mods we put the name of the mod and even the version number in there, even if it means the additional step of having to rename the file after copying it over.
It's hard to support anyone in this forum (where everyone can see what everyone else is writing, short of private messages), usually because both sides are unclear / keep holding information back / don't answer questions / talk at crosspurposes.
If it's still a problem with the firmware, exchanging the device won't help and all you can do is wait (or find a workaround like turning off all wifi and syncs).
On my H2O, so far no drain issues with 4.1.7729 (but it only happened every few days with 4.0). I caught it syncing once unwanted [it's disabled in the settings and all] after opening collections. Still shows the old sync date too but it was spinning and displays sync finished at the top and everything. Oh well.
