As I've already pointed out they may be being self-pubbed by the estate. It's happened time and again where an author (or their estate) will grab a cover from somewhere (either the current paper edition or a cover from another market) and use that not thinking about copyright issues. They've also been known to fill in the last print publisher as publisher. These books are pretty obviously not being sold by Harper, but that doesn't mean they aren't being put out by the estate. Often a print publisher on old backlist titles don't also have the digital rights.
I gave you a lead on a possible contact for the estate. If you don't plan to pursue that at all, or any other research, then there's no point in going on and on about these being pirated.
