Hi SKK, yes as Shalym has said, it definitely sounds like a hardware issue to me. Is your Kindle jailbroken by any chance? If not I would try and contact Amazon and see if they are willing to swap it out. It definitely shouldn't function like that. It may be something Amazon are already aware of and swap out devices when it happens.
