Many people have sent jailbroken Kindles in under warranty, we haven't yet heard of anyone being rejected.
Note that no one has been foolish enough to send in their Kindle with an active Screensavers hack making it impossible not to realize from a simple glance that it is jailbroken. If you rub their face in it, they will presumably be forced to reject your Kindle.
