I am pretty sure I have heard Kobo owners claiming that the Kobo's highlighting sensitivity issues are a software problem, since it only affects one of the two formats the Kobo uses. Either EPUB or KEPUB, but I certainly cannot be bothered to keep track of which one.
The Kobo uses different rendering engines for each. Apparently this is not the only amusing result.
