Kobo have not updated either the desktop application or the firmware on their devices since sometime in January. No one else is reporting anything at all like you are reporting.

Yes, Kobo only allow syncs to their server for books if you are using the current firmware. That is their choice and is a common policy for companies so that they don't have to support a lot of different versions. I think Kobo is to Draconian with this as they force the update immediately. They should be allowing the upgrade to be delayed at least a few days in case upgrading at that time was inconvenient. But, this can be easily avoided by not syncing to Kobo and sideload all your books.
