There are most definitely some stores that use the new DRM.
Using later versions of ADE when the old version is still available and works, is just utterly foolish (unless you simply don't value DeDRMing your books).
Whether the book refuses to download with older versions of ADE (alerting you so you can return it) or encrypts itself with the new DRM
when initially available, thus permanently ruining the book, but falls back on the legacy DRM with older versions of ADE, there is certainly a risk, and an advantage to staying with ADE 2.0 -- and sticking your head in the sand is very, um, bad advice.
