The Supremes declined to hear the case leaving the 9th circuit ruling in place. The 9th circuit also ruled that not everything in comics and movies deserved copyright protection

I suspect that we will see a lot of the decline to hear from the Supreme Court for a while. The thing to keep in mind is that the 9th Circuit ruling is not binding on any other Circuit courts.
