Basically, in the US, an item is in the public domain if it was first published prior to 1923. If it's published in 1923 or later, it's unlikely to be in the public domain.

Australia has a "life+70" copyright law, so it's in the public domain if the author died in 1945 or earlier (with a few complications due to changes in copyright term length in the past).

At the end of the day, as with any other aspect of life, it's the individual's responsibility to be familiar with the laws of their own country.
