The publishers set the prices. They've put out articles discussing pricing and have mentioned that they are under an obligation to price as they are told and that when the US allows discounting it hurts their business. (They put out a big articles when the publishers lost the collusion case mentioning it would hurt them because Amazon would be allowed to discount again).
