That's not entirely true. Remember, "fair use" is a
defence against copyright infringement, so by claiming a defence of fair use you yourself are admitting that you've violated someone's copyright. It's then the job of the court to judge whether or not your use of the copyright holder's material falls within the usage limits granted under "fair use".
