It turned out the "Kindle" launched in September was the Fire, and in the latest(?) conversation @Gazella had, the ACS person said:

Now I will certainly grant you that Amazon seems to have been trying to confuse people
and there still is no solid guarantee that ACS was telling the truth.
Although I think they would be foolish to lie.
