Not margin settings at and definitely not a "quirk". These are design choices of the people creating the reader. And the top is only displayed for kepubs. Yes, I agree they could be made smaller, but I don't think by that much without crowding the screen. The patches are the only way around this.

Probably not. If you convert to kepub, you get the title displayed and you obviously don't want that. Kobo ereaders do a very good job of interpreting the code in an epub to epub 2 standards. But, as every epub reader application or device interprets the standards differently, or use different defaults, if you have made changes to you epubs to get a look you like, you will probably need to make some changes to achieve the same look when you move to a different application or device.
