When you go shopping at a B&M store and see something with a designer label, say, do you think it's up to you to check whether it's counterfeit merchandise? Or do you rely on the store to fairly represent the items it offers?
There's a lot of material in the public domain because copyrights weren't renewed, back when renewals were required. It's not just a matter of looking at the year of publication and/or the author's death.
