You're either very confused, or your userstore is scrambled, or the storage device is borked.

So, before the nuclear option(s):

* What do you mean by 'can't get it to update'? Update to what? When/where/with which exact error message(s) does it fail?

* How do you check that the device is jailbroken? (... because there isn't any obvious method, besides trying to install a custom package).

* Hard factory reset (a link was posted to that in one of the nearby threads just now).
* Kubrick (cf. sticky)
