Yes, that's what is happening. I bought something recently that was "EPUB3 (DRM-Free)". It has the download button in the library, but gives a 404 error when pressed. I discussed it with the Kobo support and eventually got this response:

I did have to prompt them through to this response as this was discussed in a long thread in the general forum. Part of reason for asking the question was to see the response. And I think that if everyone who hits this politely complains, then Kobo will eventually fix it. They might simply remove the download button, but if we also point that we want to read the epub3 version using some other device or app, then that might put pressure on them to allow the download.
