No, that routine doesn't "convert to ePub" - it optimizes the EPUB by stripping out extra gunk. Kepubs work fine as EPUBs; they just have a lot of bloated code inside that the plugin disposes of.

But hey, don't take my word for it. I only wrote the routine in question. What would I know about it?
I did have a look and yes Kobo is still making kepub ONLY out of publisher ePub 3. Here's a link to one such from St. Martin's Press. http://store.kobobooks.com/en-US/ebook/unbreakable-40.

Kobo is not deciding if publishers should or should not make ePub 2 or 3. What Kobo is doing is seeing that if an ePub sent to them is ePub 3, they convert it to kepub and do not let it be downloaded as ePub. They do not sell it as ePub but kepub only. So as more publishers switch to ePub 3, Kobo will only be able to sell it to those with a Kobo Reader or Kobo software. Yes, you can use Kobo Dsktop to download, Obok to remove the DRM (if it has any) and Modify ePub to convert it back to ePub. But that's a lot more work then just going to Google Play and buying it there (unless you get a good price via a coupon or it's not available via Google).

The reason I say making ePub 3 is needless is because the publishers are not doing anything with the ePub 3 that cannot be done with ePub 2. If someone uses Sigil with one of these ePub 3 and goes to use Flightcrew to verify it, it'll come up with a number of errors. They are moving to ePub 3 with no reason at all to do so. Just because you can doesn't mean it's a good idea.
