Syncing your eReader will update it to the latest firmware, but Kobo rolls out the firmware over a couple of weeks (when you get it depends on your affiliate setting in the config file, which is set based on where you bought the device from). So right now for some people the latest version is 3.7/3.8, for others it's 3.11. You can manually load it as described above if you're in a hurry though.

Because it's a private device rather than a public area. Why should you put up with advertising for something you're not interested in?
Manufacturers pushing this sort of thing onto private devices has become a bit of a plague in the last few years. I've virtually stopped buying new computer games because every one seems to come with a requirement to install some unrelated storefront or other before you can play it.
Obviously there's got to be a bit of give and take. Improvements to features to enticements to advertisements isn't a clear cut continuum but something like facebook that's a single commercial entity should certainly be optional.
