I never bought from Simon & Schuster directly, since they did not want my money. (Literally - they said "Because you live in Austria, we do not want to sell you the book." - So I bought it, the same book, from Kobo.)
I just did a quick search, the Kobo Terms of Use use the word "buy" quite often, so if they really mean that you're only leasing it, then I'd bet the terms are worthless.
The word "lend" or "lease" never appeared.
Also, my response is not only to S&S or eBooks but DRM in general. One of the worst examples are DVDs.
