Sorry, but without a way to recreate it (even once) I can not find the bug to fix it.

1) this builds the TOC from the NCX

2) It almost never fails on a fresh (book) open. (After A crash, I build the HTML TOC just fine)
3) This issue has been there for quite some time (a PITA bug ).
Some odd race between the NCX, OPF and the HTML?
