Sadly, the content of the epubs that Tor is putting out with the epub3 versioning make very minimal use of epub3's extensions to the epub2 specification -- well, that was the case with 4 that I looked at (1 full ebook and 3 previews). As near as I can tell, all that was done was to add an epub3 nav.xhtml and an epub3 style content.opf. OTOH, they also included the deprecated toc.ncx file so I'd term these epub2/3 ebooks.

At times, I think Kobo is going to have to start running those "epub3" ebooks through an old epub2 reader just to see if they should make them downloadable as an epub2.
