Read again.
I didn't say they deserved to go out of business but rather that they are better off out of a business they didn't know how to compete in.
Makes a difference.
Especially when what put them out of business was failing to deliver product in time for prime selling season, leaving them stuck with excess product and bills they couldn't pay. That goes beyond not understanding regulations to failing to understand the market they expected to save an already floundering business. (Standard industry practice for new products is to wait for design certification before proceeding to manufacture them. Manufacturing before certification is risky business.)
Not everybody is cut out for competitive businesses, much less international consumer electronics.
As to the FCC regulations favoring big companies over small, there's plenty of Kickstarter projects that have no problem getting certified. Companies don't get much smaller. And it's not as if the three month thing is a secret.
