The issue here isn't about evading the law (not from my perspective), it's about legal procedure and practice. If a person 'held' the data required then the person and the data would be subject to legal procedures, eg extradition (or whatever).

In this case the data is being stored in Ireland by a non-Irish company (Microsoft) who is subject to Irish laws in Ireland. (And if Microsoft has this data stored in an Irish registered Microsoft company then that is another aspect that is not indicated in the Article, but could be the case.)

It would seem that the US considers that it can circumvent extradition procedures because what they require is 'data'; and that obtaining an Irish search warrant is not required.

The Irish point of view would be interesting .....
