I never thought of it that way. If that is the case, then Apple should label them as such in the listing so people buying them will know not to if all they have is a 1st Gen iPad.
When I've gone to download an app that's used to work on iOS 5 and now needs iOS 6 or 7, I can download an old version. I would think iBooks would act the same way.
