Kobo would only be able to sell Kindle format ebooks that are DRM free, because they don't have access to the necessary data to download the encrypted versions to your Kindle devices. It's one of the three reasons why Amazon has such a lock on the ebook market in the US, the other reasons are that their website is superior to everyone else and whispersync makes it so darn easy to buy books and read them immediately (yes, I know you can do the same at B&N store with a Nook, or at Kobo with a Kobo device and maybe a Sony).
